Surrogacy in Colombia: Exploring challenges and unresolved questions

Surrogacy encompasses a variety of situations today, that reflect its complexity from ethical, legal, and social perspectives. In Colombia, surrogacy is not expressly prohibited, and the country faces a lack of regulation. A recent attempt to address this gap was the introduction in 2023 of a law “through which uterine surrogacy for gestation in Colombia is regulated”, however, as of now, it has been archived due to the expiration of its processing deadlines. Finally, based on the analysis of several cases, arguments, and counterarguments are presented, with postures that allow an exploration of nuances of surrogacy.

Abstract
In November 2023, the XI Bioethics Conference of Clínica Colsanitas was held. Within the framework of this event, the presentation was made: VIABILITY LIMITS IN NEONATES AND BIOETHICAL CONFLICTS. From this intervention, the following document emerges, which has to do with the beginning of life, the viability limit of newborns. November 17 is the international day of prematurity, it is a topic of vital importance if one takes into account that the World Health Organization (WHO) (2023) concluded that in the last decade 1,520,000,000 were born, that is, 1 in 10 births in the world are premature and, most alarmingly, every 40 seconds one of them dies worldwide. This conference shows the importance of health teams in Neonatal Units at the time of decision-making from bioethics, from the Colombian and global context at the limit of viability.

SUMMARY

Introduction. To reflect about Advance Directives in Pediatric patients represents a challenge for healthcare personnel. Objective: To provide the reader with guidelines to reflect on how to assertively approach the patient and their family in the face of an extreme health condition through advanced care planning where the advance directives and advance directives document are part of the patient's comprehensive care. Methods: Narrative type review.

Conclusions: The advance directives and the advance directives document are part of the advanced care planning where the care staff has the responsibility of guiding, accompanying and co-creating the advance directives document with the child and adolescent through an empathetic and appropriate therapeutic relationship.
